These Terms of Service ("Terms") govern your access to and use of MyFunding ("MyFunding", "we", "us", or "our") and the services, software, and websites we make available (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Accounts

To use most features of the Services you must register an account. You agree to provide accurate information, keep it up to date, and keep your credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly at info@myfunding.app of any unauthorized use.

2. Acceptable Use

You agree not to, and not to permit any user to:

• Use the Services in violation of any applicable law or regulation.
• Send unsolicited commercial messages, spam, or abusive communications.
• Upload or transmit malicious code, or attempt to disrupt or probe the Services.
• Reverse engineer, decompile, or attempt to extract the source code of the Services.
• Use the Services to collect information in violation of others' rights or privacy.

3. Your Content

You retain ownership of any data, submissions, forms, workflows, messages, and other material you provide or generate through the Services ("Your Content"). You grant us a limited, non-exclusive license to host, process, and transmit Your Content solely as needed to provide the Services to you.

4. Subscriptions and Billing

Paid plans are billed in advance on a recurring basis. Fees are non-refundable except where required by law. We may change plan prices or features with reasonable notice; changes apply to your next billing cycle. Overages (such as additional leads or messages beyond your plan's included volume) are billed as described on our pricing page at the time of use.

5. Free Trial

We may offer a free trial. At the end of the trial, you will be charged for the plan you selected unless you cancel before the trial ends.

6. Termination

You may cancel your account at any time from your account settings. We may suspend or terminate your access if you materially breach these Terms, create a security or legal risk, or fail to pay amounts owed. Upon termination, your right to use the Services ends immediately. We will make Your Content available for export for a reasonable period after termination, after which it may be deleted.

7. Third-Party Services

The Services may integrate with third-party services (for example, email, SMS, or webhook destinations). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.

8. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, MyFunding and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services. Our total liability for any claim relating to these Terms or the Services will not exceed the amounts you paid to us in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless MyFunding and its affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising out of your use of the Services, Your Content, or your violation of these Terms or applicable law.

11. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Services. Continued use of the Services after the changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which MyFunding is established, excluding its conflict-of-laws rules. The exclusive venue for disputes will be the competent courts in that jurisdiction, unless otherwise required by applicable consumer-protection law.
